Kubehost Terms of Service

Effective Date: October 10, 2025

1. Agreement

These Terms of Service ("Agreement") constitute a legally binding contract between you ("User") and Kubehost ("we," "us," or "our"). By accessing or using our services, you agree to be bound by these terms. If you do not agree, do not use our services.

2. Services

Kubehost provides web hosting, domain registration, cloud storage, and related services (collectively, "Services"). All services are subject to this Agreement.

3. Account Responsibilities

By creating and maintaining an account with Kubehost, you acknowledge and agree to the following responsibilities and obligations:

• Accurate Information: You must provide complete, accurate, and up-to-date information during registration and keep it current at all times. Kubehost is not responsible for any issues, losses, or damages arising from incorrect or outdated information you provide.
• Account Security: You are solely responsible for maintaining the confidentiality and security of your account credentials, including your username, password, API keys, or any other authentication information. You agree to take all reasonable precautions to prevent unauthorized access to your account.
• Authorized Use: You are fully responsible for all activities that occur under your account, whether or not authorized by you. This includes actions taken by any person who gains access to your account with or without your knowledge.
• Immediate Notification: You must notify Kubehost immediately if you suspect or become aware of any unauthorized use, breach, or compromise of your account. Failure to promptly notify us may limit your ability to recover lost or compromised data and may result in further liability.
• Compliance with Laws: You agree to use your account only for lawful purposes and in compliance with all applicable laws, regulations, and this Agreement. You may not use your account to engage in illegal activities, fraud, spamming, or any activity that infringes the rights of others.
• Prohibited Sharing: You may not share, sell, or otherwise transfer your account credentials to any third party without prior written consent from Kubehost. Unauthorized sharing or use of accounts may result in immediate suspension or termination.
• Liability: Kubehost is not responsible for any loss, damage, or liability resulting from unauthorized access, account misuse, or failure to comply with these Account Responsibilities. You agree to indemnify and hold Kubehost harmless from any claims arising from your account activities.
• Account Suspension or Termination: Kubehost reserves the right, at our sole discretion, to suspend, restrict, or terminate your account for violation of this Agreement, suspicious activity, or security concerns. Suspension or termination does not relieve you of any obligations, including payment obligations, incurred prior to such action.

This section survives the termination or expiration of your account and continues to apply to any activity conducted under your account while it was active.

4. Acceptable Use

By using Kubehost services, you agree to use our services responsibly, ethically, and in compliance with all applicable laws, regulations, and this Agreement. You further agree not to engage in any activity that could harm Kubehost, our network, other users, or third parties.

• Illegal Activities: You may not use our services to engage in any activity that is illegal, fraudulent, or violates local, national, or international law. This includes, but is not limited to, activities such as identity theft, money laundering, terrorism, or criminal threats.
• Unauthorized Access & Hacking: You may not attempt to gain unauthorized access to any computer systems, servers, networks, or accounts, including Kubehost’s systems, other users’ accounts, or third-party systems. Activities such as hacking, cracking, port scanning, and exploiting vulnerabilities are strictly prohibited.
• Malware & Security Threats: You may not upload, distribute, or transmit viruses, malware, spyware, ransomware, or any other malicious code that could disrupt, harm, or compromise the security or functionality of Kubehost’s services, systems, or other users’ content.
• Spamming & Unsolicited Communications: You may not use Kubehost services to send unsolicited email, SMS, or other communications, including bulk messaging or phishing campaigns, or to collect contact information for such purposes.
• Intellectual Property Infringement: You may not use our services to upload, store, distribute, or share content that infringes or misappropriates the intellectual property rights of others, including copyright, trademark, or trade secret violations.
• Obscene, Offensive, or Harmful Content: You may not use our services to host, share, or transmit content that is unlawful, obscene, defamatory, harassing, threatening, abusive, or otherwise objectionable.
• Network Abuse & Resource Misuse: You may not use our services in a manner that disrupts, degrades, or interferes with the services of Kubehost or other users. This includes excessive use of bandwidth, denial-of-service attacks, or automated scripts that negatively impact the network.
• Compliance with Laws: You are responsible for ensuring that all content, communications, and activities conducted through your account comply with all applicable laws and regulations.
• Kubehost Rights & Enforcement: Kubehost reserves the right, at our sole discretion, to investigate any suspected violations of this section. We may suspend, restrict, or terminate accounts, remove or disable content, or take other actions necessary to enforce this Agreement. Kubehost is not liable for any actions taken to protect the integrity, security, or availability of our services.
• Indemnification: You agree to indemnify, defend, and hold harmless Kubehost, its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, or expenses arising from your violation of this Acceptable Use Policy or applicable law.

This Acceptable Use section is intended to protect Kubehost and all users and continues to apply even after your account is terminated or suspended.

5. Free Domain Offer

Users who purchase a minimum 3-year hosting package are eligible for a free domain registration through Kubehost. The free domain is subject to availability and renewal rules. Kubehost reserves the right to revoke or modify the offer at any time. Users are responsible for renewing the domain after the first registration period, and Kubehost is not liable for domain expiration due to user inaction.

6. Data Security and Backups

Kubehost employs industry-standard technical, administrative, and physical measures to help protect your data from unauthorized access, loss, or disclosure. These measures include, but are not limited to, firewalls, encryption protocols, intrusion detection systems, regular server monitoring, and periodic backups. While we strive to maintain the integrity and security of your data, you acknowledge and agree to the following:

• User Responsibility: You are solely responsible for maintaining independent, up-to-date backups of all your content, files, databases, email accounts, and any other data stored or transmitted using Kubehost services. Kubehost strongly recommends implementing a robust backup strategy outside our systems to prevent potential data loss.
• No Guarantee of Recovery: Kubehost does not guarantee the restoration or recovery of any data in the event of accidental deletion, corruption, hardware failure, software malfunction, hacking, security breaches, or any other circumstances, including those beyond our reasonable control.
• Temporary Service Interruptions: Data loss or corruption resulting from temporary service interruptions, maintenance, updates, or errors in our backup procedures is not the responsibility of Kubehost. You accept that such interruptions may occur despite our best efforts to prevent them.
• Third-Party Services: Kubehost is not responsible for data loss caused by third-party software, plugins, scripts, or applications installed or used by you. You are responsible for ensuring that any third-party components are compatible with our services and properly backed up.
• Limitation of Liability: To the fullest extent permitted by law, Kubehost shall not be liable for any direct, indirect, incidental, consequential, or special damages, including loss of data, revenue, profits, business opportunities, or reputation, arising from the use, misuse, or inability to use our services, even if we were advised of the possibility of such damages.
• Data Retention and Deletion: Kubehost reserves the right to delete accounts, data, or backups in accordance with our policies, including account termination, prolonged inactivity, or policy violations. You are solely responsible for retaining any data you wish to preserve before such actions occur.
• Indemnification: You agree to indemnify, defend, and hold harmless Kubehost, its affiliates, officers, employees, and agents from any claims, losses, damages, liabilities, or expenses arising from your failure to maintain independent backups, loss of data, or misuse of the services.

By using Kubehost services, you acknowledge that while we take reasonable measures to safeguard your data, ultimate responsibility for data security and backup rests with you. Kubehost makes no warranties or guarantees regarding data integrity or recovery.

7. Service Availability and Uptime Guarantee

Kubehost strives to provide 99.9% uptime for all hosting services. However, this guarantee does not make Kubehost liable for downtime caused by:

• Scheduled maintenance or emergency server upgrades
• Network outages outside Kubehost’s control
• Force majeure events, hacking, or malicious attacks
• User misconfiguration or third-party software issues

If uptime falls below 99.9% in a given month, Kubehost may offer service credits at our discretion, but we are not liable for any direct, indirect, or consequential damages resulting from downtime.

8. Payment Terms

• Fees are due in advance and non-refundable unless otherwise stated.
• Kubehost reserves the right to suspend or terminate service for non-payment.
• Pricing may change at our discretion; current rates are posted on our website.

9. Suspension and Termination

Kubehost reserves the right, at its sole and absolute discretion, to suspend or terminate your account, access to services, or any portion thereof, with or without notice, for any reason or no reason at all. This includes, but is not limited to, termination due to:

• Violation of this Agreement, including the Acceptable Use Policy
• Engagement in illegal or unauthorized activities
• Non-payment of fees or overdue balances
• Suspected fraud, security breaches, or misuse of services
• Operational, technical, or business reasons, including server maintenance, migration, or capacity issues
• Changes in Kubehost’s business model, restructuring, or cessation of operations

By using Kubehost services, you expressly acknowledge and agree that Kubehost may terminate your access or suspend services at any time, with or without cause, and without incurring any liability or obligation to provide refunds beyond any discretionary policies described herein.

• No Liability for Termination: Kubehost shall not be liable for any losses, damages, or expenses resulting from suspension or termination of services, including but not limited to loss of data, revenue, profits, business opportunities, or goodwill.
• Outstanding Obligations: Termination of your account does not release you from any obligations to pay outstanding fees or charges incurred prior to termination, nor from any other obligations under this Agreement that, by their nature, survive termination, including but not limited to indemnification, intellectual property, and limitation of liability provisions.
• Data Retrieval: Upon termination, your access to services will cease immediately. It is your responsibility to retain independent backups of your content and data. Kubehost is under no obligation to store or return any content following termination.
• Discretionary Credits: Any service credits, refunds, or other remedies are granted solely at the discretion of Kubehost and do not constitute a contractual obligation.
• Indemnification: You agree to indemnify and hold harmless Kubehost, its affiliates, officers, employees, and agents from any claims, losses, damages, liabilities, or expenses arising from your use of services or from suspension/termination of your account.

This section survives termination and shall apply to all accounts and services regardless of the reason for suspension or termination.

10. Intellectual Property and User Content

All Kubehost trademarks, logos, trade names, service marks, designs, patents, copyrights, domain names, software, technology, and other proprietary materials (collectively, "Kubehost IP") are and will remain the exclusive property of Kubehost or our licensors. Nothing in this Agreement grants you any rights to Kubehost IP except as explicitly set forth herein.

You retain ownership of any content, data, websites, or materials you upload, submit, or host through our services ("User Content"). By using Kubehost services, you grant Kubehost a worldwide, non-exclusive, royalty-free, fully sublicensable license to use, store, copy, reproduce, modify, transmit, display, and distribute your User Content solely as necessary to provide, maintain, and improve the Services, including but not limited to:

• Hosting and displaying your websites and content on our servers.
• Performing backups, caching, and content delivery.
• Analyzing usage patterns and improving service performance.

Kubehost is not responsible for monitoring User Content, and we do not guarantee the security, privacy, or integrity of your data beyond our standard backup and security procedures. You are solely responsible for maintaining independent backups of all User Content.

Kubehost reserves the right to remove, disable, or refuse to display any User Content that we believe, in our sole discretion, may:

• Infringe any intellectual property, proprietary, or privacy rights of a third party.
• Violate applicable laws or regulations.
• Violate this Agreement or our Acceptable Use Policy.
• Be harmful, offensive, defamatory, or otherwise objectionable.

Upon termination of your account, Kubehost may delete all User Content hosted on our servers unless you have made independent backups. Kubehost shall not be liable for any loss of User Content resulting from account suspension, termination, or service discontinuation.

You represent and warrant that your User Content does not infringe the intellectual property rights of any third party and that you have all necessary rights to grant the license described above. You agree to indemnify and hold harmless Kubehost from any claims, damages, or expenses arising from alleged or actual infringement of third-party rights by your User Content.

This section survives the termination or expiration of your account and continues to apply with respect to User Content you have uploaded during your use of the Services.

11. Third-Party Services

Kubehost services may include or rely upon software, applications, APIs, integrations, or other services provided by third parties ("Third-Party Services"). These may include, but are not limited to, payment processors, domain registrars, content delivery networks, email services, and analytics tools. Your use of Third-Party Services is subject to the terms, conditions, and privacy policies of those third-party providers.

Kubehost is not responsible or liable for:

• The availability, reliability, performance, or security of any Third-Party Service.
• Any errors, delays, or interruptions in the operation of Third-Party Services.
• Any loss or damage of any kind resulting from your use of or reliance on Third-Party Services.
• Any content, products, or services offered by third parties.

Kubehost does not endorse or assume responsibility for any third-party products, services, or content made available through our services. You acknowledge and agree that your use of Third-Party Services is at your sole risk, and you are solely responsible for evaluating their suitability and ensuring compliance with applicable laws.

Kubehost reserves the right, at our sole discretion, to suspend, modify, or remove access to any Third-Party Services without prior notice. Kubehost may also impose additional terms, fees, or restrictions for the use of certain third-party integrations.

By using Kubehost services that incorporate Third-Party Services, you agree to:

• Comply with all third-party terms, policies, and legal obligations.
• Release, indemnify, and hold harmless Kubehost from any claims, damages, or liabilities arising from your use of Third-Party Services.
• Not hold Kubehost responsible for any disputes between you and third-party providers.

This section survives the termination or expiration of your account and continues to apply with respect to any use of Third-Party Services during your use of Kubehost services.

12. Privacy and Personal Information

Kubehost is committed to protecting the personal information of its users. Our collection, storage, and use of personal data are governed by our Privacy Policy. By using our services, you acknowledge and agree to the practices described in the Privacy Policy and consent to the collection and use of your information as outlined therein.

While Kubehost implements industry-standard technical, administrative, and physical measures to safeguard personal data, including encryption, firewalls, secure servers, and restricted access, no system can be guaranteed to be completely secure. Accordingly, you expressly acknowledge and agree that:

• Kubehost does not warrant or guarantee that personal data will be completely protected against unauthorized access, disclosure, modification, or destruction.
• We are not responsible for any loss, theft, or unauthorized use of personal information, whether resulting from hacking, phishing, malware, social engineering, human error, or other malicious activity by third parties.
• Kubehost shall not be liable for any damages, losses, costs, or expenses arising directly or indirectly from any leak, breach, or exposure of personal information, including but not limited to identity theft, fraud, or reputational harm.
• Users are responsible for safeguarding their own account credentials and for implementing additional security measures, such as secure passwords, two-factor authentication, and independent backups of sensitive data.
• Kubehost may share personal information with trusted third-party service providers only to the extent necessary to provide services, but Kubehost assumes no liability for the actions, security practices, or data handling of such third parties.
• Users are solely responsible for the accuracy, completeness, and legality of any information they provide to Kubehost. Kubehost is not liable for consequences arising from false, misleading, or incomplete information submitted by users.
• By using Kubehost services, you expressly acknowledge that no transmission of data over the internet or storage system can be guaranteed to be 100% secure, and you accept and assume all risks associated with the use of our services, including the potential loss, leak, or exposure of personal information.

This section, together with our Privacy Policy, constitutes the full agreement regarding personal information and data protection, and survives termination of your account or cessation of services.

13. Limitation of Liability

• Kubehost and its affiliates, officers, directors, employees, agents, and licensors (collectively, the "Kubehost Parties") shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including, but not limited to, loss of profits, revenue, data, use, goodwill, or business opportunities, arising from or related to your access to or use of our services, whether based on contract, tort, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
• The total aggregate liability of Kubehost for any and all claims arising from or relating to your use of our services, products, or website, or any content or data therein, shall be limited to the total amount you paid to Kubehost for the services in the three (3) months immediately preceding the event giving rise to the claim, regardless of the number or nature of claims.
• Kubehost is not responsible for any loss of data, files, or information stored, transmitted, or processed using our services, including but not limited to:
  • failure to maintain your own backups;
  • hacking, malware, ransomware, or other cyberattacks;
  • third-party service failures, including but not limited to cloud providers, domain registrars, or payment processors;
  • hardware, software, or network failures;
  • natural disasters, fires, floods, earthquakes, acts of war, terrorism, or other force majeure events.
• Kubehost does not guarantee uninterrupted, secure, or error-free service. We are not liable for service downtime, delays, or interruptions, even if caused by maintenance, upgrades, network outages, or third-party issues.
• The free domain offer, promotional credits, or uptime guarantees provided by Kubehost do not create additional liability beyond the specific service credits or remedies described in this Agreement or any related service-specific terms.
• Kubehost is not responsible for any damages, losses, or claims arising from the unauthorized access, disclosure, or breach of your personal or business data, whether due to your own security failures, phishing attacks, password compromise, or any other cause outside Kubehost’s reasonable control.
• By using our services, you acknowledge and agree that you assume all risk related to the use of our services and any data stored or transmitted therein, and that Kubehost Parties are not liable for any losses or damages, even if foreseeable or arising from negligence, misrepresentation, or strict liability.
• This limitation of liability applies to the fullest extent permitted by law, and some jurisdictions may not allow certain limitations, in which case Kubehost’s liability shall be limited to the maximum extent permitted by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless Kubehost, its affiliates, officers, directors, employees, agents, and licensors (collectively, the "Kubehost Parties") from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees and court costs, arising out of or related to:

• Your use of or access to Kubehost’s services, products, or website;
• Any violation or alleged violation of this Agreement, including failure to comply with applicable laws or regulations;
• Any content, data, or materials you submit, post, transmit, or store using Kubehost’s services;
• Any unauthorized or unlawful use of Kubehost’s services, including hacking, spamming, phishing, or attempts to breach security;
• Claims by third parties arising from your actions or omissions, including but not limited to infringement of intellectual property rights, privacy violations, defamation, or other harm;
• Any negligence, misconduct, or breach of contract by you in connection with your use of the services.

This indemnification obligation survives the termination or expiration of this Agreement and applies regardless of whether the claim arises in tort, contract, strict liability, or any other legal theory. You agree to cooperate fully with Kubehost in the defense of any such claims, and Kubehost reserves the right to assume sole control of the defense and settlement of any claim.

15. Modifications

Kubehost reserves the right, at its sole discretion, to modify, update, or revise these Terms of Service, Privacy Policy, service offerings, features, pricing, or any related policies at any time without prior notice. Such modifications may include changes to:

• Terms governing your use of our services, including limitations, obligations, and indemnification clauses;
• Fees, billing, payment methods, or promotional offers;
• Service availability, features, technical specifications, or functionality;
• Privacy practices, data handling, or security protocols.

Your continued access to or use of Kubehost services after the effective date of any modifications constitutes your acknowledgment, acceptance, and agreement to be bound by the updated terms. If you do not agree with the modified terms, you must immediately cease use of the services.

Kubehost may, but is not obligated to, provide notice of such changes via email, website notification, or other reasonable means. Modifications may take effect immediately or on a specified effective date, at Kubehost’s discretion.

You agree that Kubehost is not liable for any consequences, damages, or losses resulting from such modifications, updates, or discontinuation of services. These terms, as modified from time to time, constitute the binding agreement between you and Kubehost, superseding any prior agreements, communications, or representations.

16. Governing Law

This Agreement, and any dispute, claim, or controversy arising out of or relating to these Terms of Service, your use of Kubehost’s services, or any other matter between you and Kubehost, shall be governed by and construed in accordance with the laws of the jurisdiction in which Kubehost is incorporated, without regard to its conflict of law rules.

• Any disputes, claims, or legal actions arising under or related to this Agreement shall be exclusively brought in the competent courts of the jurisdiction in which Kubehost is incorporated, and you hereby consent to the personal jurisdiction and venue of such courts.
• You waive any objection based on forum non conveniens, inconvenient forum, or lack of jurisdiction to the fullest extent permitted by law.
• The parties agree that any court judgment or order rendered by such courts shall be final, binding, and enforceable, and may be entered and enforced in any other jurisdiction as necessary to protect Kubehost’s rights or interests.
• Nothing in this section prevents Kubehost from seeking injunctive relief or enforcement of its rights in any other jurisdiction where necessary to protect its intellectual property, confidential information, or business interests.
• This governing law clause survives termination or expiration of this Agreement.

By using Kubehost’s services, you expressly agree that this governing law provision applies to all disputes, claims, or controversies, and you acknowledge that it provides certainty regarding applicable law and venue for the resolution of any claims.

17. Entire Agreement

This Agreement, together with any policies referenced herein, constitutes the entire agreement between you and Kubehost regarding the use of services.

18. Cessation of Services

Kubehost may, at its sole discretion, discontinue or terminate all or part of its services, including in the event of business closure, sale, or reorganization. Users are solely responsible for maintaining backups of their content and data. Kubehost shall not be liable for any losses, damages, or costs arising from the discontinuation of services, including but not limited to loss of data, revenue, or access to websites hosted with Kubehost. Any prepaid fees are non-refundable unless otherwise stated at our discretion.

By using Kubehost services, you acknowledge that you have read, understood, and agree to these Terms of Service.
